NOTICE OF SPECIAL MEETING

ZONING BOARD OF ADJUSTMENT OF THE BOROUGH OF KINNELON

MORRIS COUNTY, NEW JERSEY

PLEASE TAKE NOTICE that the Zoning Board of Adjustment of the Borough of Kinnelon (the “Board”) will hold a Special Meeting on Tuesday, July 28, 2026 at 7:00 p.m. at the Municipal Building, Council Chambers, 130 Kinnelon Road, Kinnelon, New Jersey. At the Special Meeting, the Board will consider whether to approve a Settlement Agreement  related to litigation entitled Palisades Properties, LLC v. The Zoning Board of Adjustment of the Borough of Kinnelon, et al., bearing Federal District Court Docket Number Civil Action No: 2:25-cv-17754-BRM-JBC, which involves a use variance application for a Cooperative Sober Living Residence on property commonly known as 21 Wood Chase Lane and listed on the Borough of Kinnelon Tax Assessment Map as Block 56301, Lot 137. Should the Board approve the settlement agreement, same shall be approved subject to a noticed hearing in accordance with applicable case law under Whispering Woods v. Middletown Township Planning Board, 220 N.J. Super. 161 (Law Div. 1987). At that hearing, all interested parties shall have the opportunity to provide comment.

TAKE NOTICE THAT ACTION MAY BE TAKEN ON THE MATTERS LISTED ON THE BOARD’S MEETING  AGENDA AND ON SUCH OTHER MATTERS AS MAY PROPERLY COME BEFORE THE ZONING BOARD OF ADJUSTMENT OF THE BOROUGH OF KINNELON.
